1. Introduction and Parties
Wayside Wimberley offers short-term vacation rentals including farmhouse cottages, the Blancobreeze glamping RV, and full-hookup RV sites located at 630 Wayside Drive, Wimberley, Texas 78676, on the Blanco River canyon (“the Property”).
The Property is owned by Stacey H Graham, LLC, a Texas limited liability company (“Property Owner”), solely owned by Stacey H. Graham. All bookings, reservations, guest services, and operations are managed by DSW Property Holdings, LLC, a Texas limited liability company (“Manager”), which is owned 50/50 by David D. Wehmeyer and Stacey H. Graham.
References to “we,” “us,” “our,” or “Wayside Wimberley” mean the Property Owner and Manager collectively. By accessing this website, making a reservation, or staying at the Property, you (the “Guest”) agree to these Terms and Conditions, which form a binding rental agreement between you and the Manager (acting on behalf of the Property Owner).
2. Reservations and Booking
Reservations are subject to availability and Manager approval. All bookings create a binding contract with the Manager. You must provide accurate information. We reserve the right to cancel any booking that appears fraudulent or violates these Terms. A confirmation email will include the rental dates, rates, taxes/fees, door code or site number, and check-in instructions.
3. Rates, Taxes, and Fees
Rates are subject to change until the booking is confirmed. We collect the Texas State Hotel Occupancy Tax (6%) where applicable. We are legally exempt from collecting the City of Wimberley Hotel Occupancy Tax (7%). Applicable taxes, cleaning fees, security deposits, pet fees (if any), or other charges will be clearly disclosed before you complete your booking.
4. Cancellation and Refund Policy
Cancellations must be made in writing by emailing hello@waysidewimberley.com.
Cottages and Blancobreeze Glamping RV
- 14 or more days before arrival: Full refund
- 7–13 days before arrival: 50% refund
- Fewer than 7 days before arrival: No refund
RV Sites
- 7 or more days before arrival: Full refund
- 2–6 days before arrival: 50% refund
- Fewer than 2 days before arrival: No refund
No refunds for early departures or no-shows. We strongly recommend Guests purchase travel insurance. In the event of force majeure (including Blanco River flooding, mandatory evacuation, or Hays County burn bans that affect the Property), we will work with you on a reschedule or credit at our sole discretion.
5. Check-In / Check-Out, Occupancy, and House Rules
Check-in and check-out times are as follows:
- Cottages and Blancobreeze: Check-in 4:00 PM | Check-out 11:00 AM
- RV Sites: Check-in 2:00 PM | Check-out 12:00 noon (noon)
Access is via keypad code provided in your confirmation email. Early check-in or late check-out is sometimes available depending on the calendar — contact us in advance.
Guests must follow the separate House Rules (linked or attached below), Pet Policy, and all conditions of the City of Wimberley Conditional Use Permit (CUP) for this Property. Maximum occupancy is strictly enforced as stated in your booking confirmation.
6. Insurance and Liability
Stacey H Graham, LLC and DSW Property Holdings, LLC each maintain separate property and liability insurance binders for the Property and operations. However, these policies do not cover Guest’s personal belongings, personal injury, or liability.
We strongly recommend that every Guest obtain their own travel/rental insurance, including coverage for trip cancellation, personal property, medical expenses, and liability.
To the fullest extent permitted by law, neither the Property Owner, Manager, nor their members, managers, officers, or agents shall be liable for any indirect, incidental, consequential, or punitive damages. We are not responsible for acts of God, flooding, flash floods, river overflow, weather events, or other natural hazards common to the Blanco River canyon location.
7. Indemnification
You agree to indemnify, defend, and hold harmless Stacey H Graham, LLC, DSW Property Holdings, LLC, and their respective members, managers, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising out of or related to your stay at the Property, your use of the website, or any violation of these Terms by you or your guests/invitees.
8. Intellectual Property
All photos, descriptions, logos, and content on this website are owned by or licensed to Wayside Wimberley. By submitting reviews or photos of your stay, you grant us a perpetual, non-exclusive, royalty-free license to use them for marketing and promotional purposes.
9. Privacy
Please review our separate Privacy Policy for details on how we collect and use your information.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the state or federal courts located in Hays County, Texas. You waive any right to a jury trial to the extent permitted by law.
11. Force Majeure
We are not liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to weather events, flooding, river conditions, natural disasters, burn bans, or government orders.
12. Changes to Terms
We may update these Terms from time to time. Your continued use of the website or making a booking after changes constitutes acceptance of the updated Terms.
